TITLE:   ASSOCIATE ATTORNEY                                                                                    JOB CODE: FULL-TIME / EXEMPT / SALARY

 

DEPARTMENT:  FORECLOSURE                                                                                    LEVEL: ATTORNEY                        

 

WORK SCHEDULE:          

Normal business hours of Monday – Friday, 8:00 AM – 5:00 PM and additional time as needed.

 

PRIMARY RESPONSIBILITY:

Responsible for performing legal services involved with Texas pre/post residential foreclosure sales, including probate, deceased debtor issues, reviewing/curing title, and conducting communications with clients, debtors, and attorneys

 

PRIMARY ACCOUNTABILITIES                                                                          

1.       Reviews and analyzes issues arising from debtor/attorney disputes, issues of notices, title, probate, reinstatement or payoff, analysis of payment histories, escrow disputes, and pursues any necessary curative methods to provide the client with clear title.

2.       Advise and confer with attorneys in a multi-state area on loss mitigation or bankruptcy issues, including workout modifications, balloon modifications, warranty deeds, subordination agreements, review of files on complex or difficult cases, and coordination of compliance and procedural issues with other departments within the Firm.

3.       Performs duties involved in probate, guardianship, receivership, litigation, wrongful foreclosure suits, TROs, tax issues, third party claims or bankruptcy issues, provides legal advice to clients, coordinates activities with opposing counsel, monitors files and documents sent to local councils, and prepares client status reports.

4.       Assist Substitute Trustees effecting the duties regarding the posting of properties for sale, bidding and sales of property, and receipt of funds. Reviews issues regarding excess funds to determine the party entitled to the proceeds and facilitate the proper disbursement to avoid associated legal concerns, and address issues involved with claimants’ requests for disbursements.

5.       Performs additional duties as requested.

Skills & Requirements

SKILLS / EXPERIENCE:

1.       Doctor of Jurisprudence with a concentration in foreclosure, bankruptcy, real property, or commercial law.

2.       Licensed to practice law in the state of Texas.

3.       Minimum two years of experience in a corporate legal department, preferably in the mortgage or banking industry.

4.       Must be PC literate and able to rapidly adapt to a variety of data base systems.

5.       Ability to represent the company in various forums to foster the desires and image of the company in the community.
